Use of the website
The customer is authorized to use the website and all its subdomains solely for the purpose of making legitimate inquiries or reservations, with the commitment not to make speculative, false or fraudulent reservations, or reservations in anticipation of demand. The customer also undertakes to provide Cerro Castor S.A. – Beaver Mountain S.A. and Punto Austral (Duna S.A.) with correct and accurate contact information, such as email address, and consents, if necessary, to its use as a means of contact.
Acceptance of terms
Visiting and using the website and all its subdomains implies the express acceptance by the consumer/customer of all general terms and conditions, which are automatically incorporated into the contract without the need for individual written transcription, and which complement and develop the applicable specific legislation without contravening it.
Use of customer contact information
The customer, as the reservation holder, guarantees that they are over 18 years of age and legally capable of using the website and all its subdomains and entering into legal obligations.
The customer guarantees that the personal data provided during the reservation process is correct and accepts financial responsibility for any transaction carried out under their name or account.
In accordance with this document, the customer authorizes Cerro Castor – Beaver Mountain and Duna to include all personal data provided in connection with a reservation, both their own and those of all persons mentioned in the reservation, in the confidential database for future communications, as established in Law 25.326, of October 20, 2000, classified as personal data protection. Ski resort services
Cerro Castor acts both as owner and provider of the resort services it offers within its domain and which are for sale on this website.
Cerro Castor's own services are: ski lift passes, accommodation at Castor Ski Lodge. Beaver Mountain: ski classes, equipment rental, gastronomy services. Punto Austral Turismo Lic. 14097 (Duna S.A.) is a travel and tourism agency acting as intermediary between the different service providers and the customer.
SKI LIFT PASSES
The purchase of the pass implies the knowledge and acceptance by the user of all of the following general conditions of sale:
1. The pass is non-transferable and non-refundable.
2. Multi-day passes must be used on consecutive days; if any day is not used, it is forfeited.
3. The company is not responsible in case of theft, robbery, loss and/or total or partial destruction of the pass. The user must pay for reprinting and/or purchase a new one to continue using the ski lifts and slopes. The same treatment will apply to a user who forgets their pass.
4. The user assumes all risks and responsibilities for damages to themselves and/or third parties caused as a consequence of the inherent risk of the winter sport practiced and/or their actions in using the facilities.
5. The pass may be used exclusively for recreational and/or sporting purposes; commercial and/or lucrative use is prohibited.
6. The total or partial closure of ski lifts due to unfavorable weather conditions and/or safety and/or operational reasons and/or other reasons does not entitle the holder to claims, refunds or exchange of the pass. Nor do unused pass days.
7. Cerro Castor will not recognize date changes or refunds on confirmed reservations outside the terms established in this document, whether due to inconveniences or modifications by airlines.
8. Handing over the pass to third parties for their use, or its alteration and/or forgery, constitutes the offense provided for and punishable under articles 172 and 174 of the National Penal Code. The pass will be immediately cancelled.
9. The pass and identity document must be presented by the user whenever requested by company staff.
10. The pass may be immediately cancelled in case of misconduct by the user and/or damage caused by them to third parties.
Cerro Castor staff may provisionally or permanently suspend the pass at any time and in any place in case of use contrary to these general conditions or contrary to morality and good customs, or if the user engages in misconduct, including acts that endanger the physical integrity of others or themselves and/or if the user does not comply with the rules established in the slope operating and safety regulations (FIS Rules).
11. Skiing and/or snowboarding and/or any other activity carried out by users outside of authorized slopes is done under their exclusive and total responsibility.
12. The purchase of the pass includes the provision of basic nursing services in case of accidents occurring exclusively on authorized slopes. If the injury requires it, the user will be provided with ambulance transport, without a doctor, to medical centers in the City of Ushuaia.
13. The pass of any user who travels on unauthorized slopes will be immediately cancelled.
14. Partial or total closure of slopes, for any reason, does not entitle the user to any claim.
15. The start and end dates of the season may change without prior notice and do not entitle the user to any claim.
16. All rates are subject to change without prior notice.
17. Types of passes:
Pedestrian pass: Allows access to people without ski/snowboard equipment. Allows a single ascent and descent to altitude 480 via the Telesilla del Bosque. It can only be purchased at the resort ticket office on the day of use.
Skier pass: Allows skiers access to all authorized ski lifts.
18. Pass categories:
Infoa: 0 to 4 years inclusive. (Requested at the ticket office presenting ID)
Minor: 5 to 11 years inclusive.
Adults: 12 to 69 years inclusive.
Senior: 70 years and over. (Requested at the ticket office presenting ID)
19. There are slopes exclusively for competitive team training, so public access to these slopes may be partially or totally restricted.
20. The purchase implies acceptance and respect of waiting times, exclusive and/or priority use of turnstiles. Cerro Castor staff may require that ski lifts operate at full capacity.
EQUIPMENT RENTAL:
The hiring of equipment rental implies the knowledge and acceptance by the user of all of the following general conditions of sale:
1. The customer is fully responsible for the theft or loss of the rented equipment or any part of it, and in either case must pay the replacement value of the equipment.
2. In case of damage or breakage, total or partial, to the rented equipment or any part of it, the customer must pay the replacement value.
3. The amounts paid by the customer for equipment rental will not be refunded under any circumstances. The transfer of rented equipment to any person other than the customer is expressly prohibited.
4. All rented equipment must be returned by the customer to company staff every day before the Cerro Castor - Ushuaia complex closes. If you wish to keep the equipment for the duration of the rental period, you must inform the rental shop so they can advise on the procedure and requirements.
5. The customer must ensure they verify and identify the rented equipment to avoid loss and/or confusion regarding which equipment belongs to them. Returns of equipment that does not correspond to what the customer rented will not be accepted.
6. Equipment rental to minors is not accepted unless they are accompanied by their parents or guardians.
7. If equipment is rented for use by a minor, their parents or guardians assume full responsibility for the rented equipment or any part of it and will be liable for theft, loss, damage or total or partial breakage.
8. The company is not responsible for theft, loss or misplacement of personal belongings.
9. The company is not responsible for accidents and/or injuries caused to themselves or third parties during the use of equipment rented by customers.
10. The total or partial closure of ski lifts due to unfavorable weather conditions and/or safety and/or operational reasons and/or other reasons does not entitle the holder to claims, refunds or exchange of rented equipment. Nor does unused equipment.

CASTOR SKI LODGE
Punto Austral (Duna S.A.) acts solely as an intermediary for accommodation and other services, as well as a booking agent on behalf of the user, and therefore cannot be held responsible for death, injury, illness, damage, loss, accident, theft, delay or any other irregularity arising, directly or indirectly, from the provision of services by the hotel or other providers that market their accommodation, services and products through the website, and is exempt from any contractual, extra-contractual or other liability. Accommodation or service providers are understood to be the providers or owners listed on the website and all its subdomains, and includes all facilities and services offered on this website and all its subdomains.
· Star rating and accommodation quality
The star rating is specific to the destination and complies with current regulations in the area. It serves merely as a general description and may not apply in all cases. The type of rooms provided by a hotel (e.g., single, double, etc.) may vary. It is the customer's responsibility to check the type of accommodation and services provided by each hotel. The customer accepts that we have not carried out quality controls of the establishments offered on the website and all its subdomains, and we are not responsible for the suitability of the accommodation or services provided. The inclusion of accommodation on the website does not imply in any case the recommendation or endorsement by Punto Austral. We disclaim any liability for any inaccuracies relating to the accommodation and services offered on the website and all its subdomains.
· Rate, reservation and payments
The rates indicated are in US dollars expressed in Argentine pesos at the exchange rate of the day. According to the contractual conditions, when confirming the reservation, the payment conditions established must be met. Rates and/or outstanding balances are updated at the exchange rate on the day of payment. The reservation will not be considered firm until 100% payment has been made. Otherwise, the reservation will be cancelled and the conditions indicated in the cancellation section will apply. Payments can be made by bank transfer and/or electronic means enabled on the website.
The reservation includes the services specified in the reservation confirmation. Please read all the accommodation information carefully (if such information is included), as it may entail supplements and additional services at an extra charge that the user must pay directly at the establishment. Cerro Castor – Beaver Mountain and Duna S.A. is exempt from any contractual, extra-contractual or other liability in relation to these services and supplements.
· Reservation requests pending confirmation
The prices and availability of the requested services are for informational purposes only and subject to availability review at the time of reservation confirmation by Castor Ski Lodge.
· Confirmation
Once the customer has made full payment for the reservation as indicated above, they will automatically receive a voucher. This is the basis of the reservation contract: the customer acknowledges that it is their responsibility to check the confirmation, as well as to verify that all the data included is correct, since services can only be provided according to the details specified in the reservation.
· Manuscript signature
Given the special characteristics of distance contracting, the customer acknowledges the impossibility of signing the payment slip, the document by which consent to the transaction is usually given. Therefore, they waive the right to sign the document for all electronic transactions generated as a result of the reservation through the website and all its subdomains. The person who fills in the reservation form on the website must be authorized to do so on behalf of all members of the group who will be traveling and must confirm that the persons forming part of the group accept the reservation conditions. Furthermore, this person will be responsible for the cost of the reservation, including cancellation or modification fees. This person will also inform the other members of the group of the confirmation details and any other relevant information.
· Delivery of documentation
In order to facilitate and expedite access to services, Cerro Castor – Beaver Mountain and Duna S.A. make available to the customer the automatic digital sending of the confirmation, voucher and invoice for services contracted and paid in full.
The customer must present the voucher issued by the reservations center in physical or digital form for the provision of services.
· Cancellation conditions and modifications
The customer may cancel their reservation without penalty within 10 days of the purchase date. After 10 days have elapsed, the following conditions apply:
Modification:
- Up to 15 days prior to Check-In, modifications may be made without penalty, subject to availability.
- Reservations that shorten their stay once Check-In has been completed will not receive a refund or credit for future reservations.
Cancellation:
- Up to 30 days before Check-In, no cancellation charges will be debited, and the amount paid will remain as credit for future reservations subject to availability. This credit is valid for 1 year from the date of cancellation.
- Between 25 and 15 days prior to check-in, 50% of the total value of the reservation will be retained as a cancellation penalty, with the remaining balance remaining as credit for future reservations subject to availability. This credit is valid for 1 year from the date of cancellation.
- Within 15 days prior to check-in, 100% of the total reservation will be retained as a cancellation penalty and will not be recognized as credit towards future stays.
Refunds:
- Castor Ski Lodge will not make refunds on cancelled or modified reservations.
If the customer cancels the reservation, costs may be incurred by accommodation and additional service providers. Each service provider and each promotion has its own cancellation and/or modification policy, which is detailed in the service description at the time of purchase.
WARRANTY
The prohibition on leaving the territory of origin imposed by the country of origin through a statement issued by a duly accredited public institution or government source.
The prohibition on entering the country, or the province of Tierra del Fuego, officially decreed by the Government of Argentina or other local authorities.
For accommodation, the modification or cancellation policies of each hotel will apply.
Flight restrictions or complete closure of Argentine airports.
FORCE MAJEURE
Cerro Castor – Beaver Mountain and Duna are not responsible for any change, cancellation or modification of the reservation, nor for any losses or damages caused by the failure of those responsible for providing the services to fulfill their respective obligations to the customer, when the failure is caused by force majeure circumstances. These circumstances include, for informational purposes and among others: wars, revolutions, terrorist attacks, border closures, natural catastrophes or any other circumstance that could seriously affect both parties, as well as any other unforeseeable circumstance that is not under the control of Cerro Castor – Beaver Mountain and Duna.
ACCURACY OF INFORMATION
The customer acknowledges and accepts that Cerro Castor – Beaver Mountain and Duna S.A. cannot be held responsible for inaccuracies in the information provided by service providers. The customer also acknowledges that: The service providers offered strive to keep all the information contained on this website up to date and accurate. Consequently, the customer is informed and accepts that the information and prices contained on this website are subject to change and are provided for informational purposes only.
LEGISLATION AND JURISDICTION
The application and interpretation of these general conditions will be governed by the current legislation of the Argentine Republic. In case of discrepancy that may arise in the interpretation or execution of any of these conditions, the parties, expressly waiving their own jurisdiction if applicable, submit to the Jurisdiction of the Courts of the city of Ushuaia, Province of Tierra del Fuego, A. e I.A.S., Argentine Republic.
